Hey Guys.

I've been trying to deal with a problem with the IRS. Basically they want more than 10k from that I don't owe and I certainly don't have.. (If I did have it, I wouldn't give it to those freakin' bastards anyway. I'd buy a fretless Series II) Anyway, they have siezed my accounts twice and now they're levying my wages.

I know we've got a couple of lawyers in here. Anyone specializing in helping people get un-screwed by the government?

Up to a few months ago, I'd would have just given them the money just to go away(if I had it). But, now I want all my money back and I want some of theirs for all the crap they have put me through over the last two years.

HELP.

I love my country. But, I fear my government.

Bill probably has a good contact. At this point you need at the very least a very good CPA specializing in tax with experience representing clients before the IRS; and at this point you may want to go with a tax attorney (an attorney who specializes in tax matters). And you're going to need to have your ducks in a row. You need to be able to document everything on the return and be able to show that the IRS's position is factually and/or legally incorrect.

As it turns out, the firm of Dewey,Cheathem and Howe are representing the IRS in this matter. In fact Dewey & Howe have already laid back on this case and all the real work is being done by the remaining partner, Cheatem.

Does anyone have a contact number for Matlock or Perry Mason

If you truly are getting unjustly treated by the feds - and I am sure you are since you say you are - I would recommend sending copies of all correspondence to your U.S. Congressman and U.S. Senators. They will have field service people in your state and in Washington who can, and do, do amazing things. (And if you don't mind the pubs, a call to your local paper could make a nice tax time story for them. Send copies of the published stories to the lawmakers, too.)

Give them a chance. The field service people are the ones who actually do all of the work. I have dealt with these guys Federal Lawmakers and their field workers for 25 plus years. Put your info together in an understandable, chronological order and find your field office and set up an appointment to go see a field rep. When you deal with the field rep, you cc copies to the lawmakers Washington D.C. office so that the field service people know you are in contact with the Washington office and vice versa. Also, if you are dealing with more than one lawmaker, a Congressman and one or two senators, then the other lawmakers don't want to look like they are ignoring your problem. Also, when the IRS sees that you are disclosing all to the lawmakers, and the news media, they have a tendancy to run for cover, especially if they are shooting blanks. I speak from experience. Give them a chance and they won't be charging you a dime.

I wonder if I could Susan W. to call the IRS for me. Then they'd run for cover.

I'm a big proponent of trying to resolve things quietly before running to the press. In my experience, once the press gets involved everyone tends to dig in their heels. On the other hand, if you've already reached this point, a little pressure from Dianne/Barbara/local congressperson might help. I'd at least talk to Henry first and get his opinion. And I would certainly think twice before siccing Susan on them. That may be like opening Pandora's box! LOL

So, nobody around here listens to "cartalk"?

Thanks Bill. The main problem is that I have a deep, deep hatred for Feinstein, Boxer and Pelosi. Did I say Hatred? Perhaps that is understating it. I was taught never to hit a girl. But I would bitch slap those b***ches all up and down the SF Bay and beyond. They have continually sold out the people of California for their own personal gain. Especially Her Majesty, Queen Pelosi The First.

Don't tell the press if that is your inclination.

If it were me I WOULD involve the field staff for my U.S. Congressional rep and U.S. Senators and let the IRS know I am working through those elected offices to resolve the issue(s). Keep the press out of it completely. I have certainly seen the 1st Amendment level the playing field for the common guy or gal.

I agree with Dave - get somone who is experienced in representing not just on tax matters, but even more specifically on these matters of personal tax at the "collection" and garnishee of wages point. There are two problems here - one is the problem of whether or not they are corrrect about whether you owe the money - and that likely requires appeals or amended filings - and the second is the jamup on not having paid them yet, so they are taking your money, which they may have lawful authority to do. You need someone who can deal with the first question, as well as negotiate and deal with the second. It is nearly impossible to get your head around sorting out the first problem when the second is occupying your mind and leaving you cashless, so you need some help there.

Two things to bear in mind. First, you can usually negotiate a payment plan with them which is usually fairly brutal but doable (at least, up here in Canada they will often negotiate such a plan). Second, if they think you owe money, they are probably charging penalties and interest on outstanding amounts even as they are garnisheeing your accounts. Those are brutal. If you can borrow the money from a financial institution, even on an interim basis while you sort out what you really owe, you will save yourself a ton of money and heartache.
