I was watching T.V. last and there I was, on a commmerical, alembic bass and myself for about a half a second, the photo that was taken 5 years ago at a gig
needless to say, it took me by suprise

Whoa, that would be strange. I guess they don't need permission if you were filmed in public?

If you are performing I don't see how they could use your image without a release. I think that is the case for any situation where you could be identified. Sure sounds like a breach of fair use to your image and privacy. Maybe one of the more knowledgeable legal folks could respond.

If it's from a public performance, I believe they can use up to 3 seconds of it royalty-free. What was the commercial about?

its for a big Motercycle rally, we played the gig 5 years ago and was not ask back.
the three bands before us were headbanging hard rock bands then we came out and country/rocked them, not purddy, oh well, we have all had gig like that!!!!!

There wasn't chain link around the stage by any chance was there? Did you win their hearts with a stirring rendition of Rawhide? Sorry, I just had this Blues Brothers-esque image fill my mind.
